1. Acceptance of Terms

2. Use of This Website

This website is provided for informational purposes and to facilitate inquiries about our services. You may not use this website for any unlawful purpose, to transmit malware, to attempt unauthorized access, or to interfere with the site's operation. We reserve the right to modify or discontinue the website at any time.

3. Web Development Services

When you engage CH Digital to build a website, the following terms apply:

• Scope: The specific deliverables, timeline, and pricing will be set out in a separate proposal or agreement. No project begins until both parties have agreed in writing.
• Client responsibilities: You agree to provide timely feedback, content, branding assets, and access to necessary accounts (hosting, domains, etc.) as required for the project.
• Payment: Payment terms (deposit, milestones, or full payment) will be specified in the project agreement. Late payments may result in project pause or termination.
• Revisions: The number of revision rounds and what is included will be outlined in the project agreement.
• Intellectual property: Upon full payment, you receive ownership of the custom work we create for your project (as specified in the agreement). We retain the right to use the project in our portfolio unless otherwise agreed.

Monthly subscription website plans

Where you select a published Starter, Growth or Pro monthly plan on chdigital.io, the following applies unless your checkout flow or a written agreement says otherwise:

• Minimum term: Plans are offered on a 12-month minimum term because design and build work is included in the subscription, not invoiced as a large separate upfront fee.
• Payments: Fees are billed monthly via the agreed payment method. Late or failed payments may result in suspension of work, hosting or access until resolved, as set out in your agreement or your payment provider's terms.
• Cancellation: During the minimum term you remain committed as agreed. After the minimum term, cancellation and notice periods follow your agreement.
• End of service / handover: What happens to the site, exports and third-party accounts when a plan ends depends on what was agreed - ask for specifics for your situation.
• Hosting and SSL: Included on active eligible plans as described on the site; not a guarantee of infinite historical backups or zero downtime.
• Domains: Domains typically remain in your registrar account; we can help connect or transfer when agreed.
• Email inboxes: Professional email hosting at your domain is not included by default; it may require third-party subscriptions billed by that provider.
• Content updates: Included changes follow your plan; work beyond that scope is quoted before it is carried out.
• Ecommerce, custom software & integrations: Shops, bookings, portals and bespoke functionality are not included unless separately scoped and agreed.
• Support: Support is provided during reasonable UK working hours and is not an emergency on-call service unless expressly agreed in writing.

4. Intellectual Property

All content on this website-including text, graphics, logos, and design-is owned by CH Digital or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

5. Third-Party Content and Services

Our website may link to third-party sites. Websites we build for you may integrate third-party services (e.g., analytics, payment processors). We are not responsible for the privacy practices or content of third parties. You are responsible for reviewing their terms and policies.

6. Disclaimer of Warranties

Our website and services are provided "as is." We do not warrant that the website will be uninterrupted, error-free, or free of viruses. For web development projects, we warrant that our work will substantially conform to the agreed specifications; any other warranties will be set out in the project agreement.

7. Limitation of Liability

To the maximum extent permitted by law, CH Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim shall not exceed the amount you paid us for the relevant service (or, for website use only, zero).

8. Indemnification

You agree to indemnify and hold CH Digital harmless from any claims, damages, or expenses arising from your use of our services, your breach of these terms, or your violation of any third-party rights (e.g., providing content you do not have rights to use).

9. Termination

We may terminate or suspend your access to our website or services at any time for breach of these terms. For active projects, termination rights and procedures will be set out in the project agreement.

10. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales, unless otherwise specified in a project agreement.

We may update these Terms and Conditions at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our website or services after changes constitutes acceptance. For active projects, the terms in effect at the time of agreement will apply unless we mutually agree to updates.
